She didn't make a mistake, she murdered him and has no business being in posession of a deadly weapon.smackaholic wrote: ↑Wed Oct 02, 2019 11:10 am Guilty of murder?
How the fukk does this happen?
It is quite obvious what happened here. A tired distracted women made a terrible mistake.
Should she get some type of punishment?
Sure.
Should she ever be allowed to carry a gun again, much less serve as a cop?
Fukk no!
But how the fukk is this murder?
Some form of manslaughter? Yeah, I guess.
If the dude she shot was white, there's no fukking way a DA even brings up a murder charge.
This was another case of "innocent balck man gets shot by the police" and dammit, we need justice!!!!
I suspect that she'll get a good legal team and this will get knocked down to what it was, some level of manslaughter.

On the point of her being in possession of a deadly weapon, we agree.Innocent Bystander wrote:She didn't make a mistake, she murdered him and has no business being in posession of a deadly weapon.smackaholic wrote: ↑Wed Oct 02, 2019 11:10 am Guilty of murder?

On the point of it being “murder”, I disagree.
She made a boneheaded, but IMO, innocent mistake. This mistake put her in a position where she felt she was in danger of being attacked.
It was certainly some form of manslaughter, but I just don’t see it as murder. To me, murder is when you kill and you know you don’t have legal reason. She thought she did.

Opening a door and shooting indiscriminately without determining whether there is an actual threat is not innocent.
Re: Amber Guyger
Manslaughter is murder with legal provocation, like finding someone molesting your kid. You shouldn’t kill them, but we understand why you did.

How do the cops accuse him of falsifying documents and possession of poloce scanners, when they've detained every electronic device which was in his possession to try to erase evidence?
I'm glad his company installed software to upload images immediately to the cloud. Does he have a chance in hell of winning, or will the cops settle without admitting guilt? What will happen to his company after this? Will the cops respect them or destroy them?
Will the bank back him up, or is he on his own?

Understanding sounds like a gray area, like pornography versus art.
Is there legal provocation to shoot to kill someone sitting on your couch, if all they're doing is sitting on your couch but not advancing towards you?
Is 'existing' a provocation enough? (ie. homeless man breaks into garage and passes out on workbench. you open the garage door and shoot him. murder or manslaughter?)

If she had walked indiscrinately into an apartment and shot someone for no good reason, she’d be guilty of murder.Innocent Bystander wrote:Kierland: ruling on proper definition of murder versus manslaughter?smackaholic wrote: ↑Mon Oct 21, 2019 4:04 pmOn the point of her being in possession of a deadly weapon, we agree.

She didn’t.
She walked into what she thought was her apartment. The apartment was in the same place with reference to the stairs/elevator as her apartment.
It was a boneheaded mistake.
She should have realized she was in the wrong apartment, but it seems her situational awareness skills ain’t all that. Plus, the apartment was
Apparently not well lit. This is typical of such apartment where you may have windows on just one wall.
The fact that the dude in the apartment aparrently didn’t notice she was in a cop uniform, explains why he mistook her for an intruder and decided a good course of action might be to rush her.
It was a collection of mistakes, unfortunate circumstances and really horrible luck. But I fail to see how it adds up to murder.

Dude was sitting on his own couch. He did absolutely nothing wrong, other than leaving his door open.
Sounds like you may need to go back and read about the circumstances of the case.

Dude was sitting on his couch eating ice cream. His apartment is directly above/below this woman’s apartment.
For whatever reason, prolly that she was a cell phone zombie, she mistook what floor she was on. She walked up to “her” apartment and found the door ajar. She went into cop mode, entered the apartment, with her side arm drawn and saw dude on the couch. She mistook him for a burglar and yelled “show me your hands kneeeegar!!!!!”
Ok, I made the last part up. I been watching that Schiff asshole too much.
He then moved toward her, obviously thinking she was an intruder.
She thought he was attacking and shot.
She made a boneheaded accident which has no explanation other than boneheaded accident.
She didn’t do it because she was hammered. She just made a mistake. Then she did a really bad job of being a cop.
To my knowledge she did not announce she was a cop. She should have.
What she should have done, upon discovering the door ajar, is take a few steps back and call for help. And maybe even figured out she was in the wrong place.
