NY State vs Feds on Trusted Traveler Programs
So recently NY State passed a law saying they would no longer allow the Feds access to their DMV database.
The Feds responded by saying NY State residents are no longer eligible for Trusted Traveler programs like Global Entry, NEXUS, SENTRI and FAST. All of these programs are voluntary and citizens pay a fee and register. Not everyone is accepted and those that are enjoy faster customs and immigration processing, faster border crossings between the US and Canada, and faster shipment clearing between the US and Canada and Mexico.
Much of the media is positioning this as the Feds retaliating for NY State allowing illegal immigrants to obtain a driver's license. That seems to miss the mark as California has been issuing driver's licenses to illegal aliens for a few years now. Their citizens aren't precluded from these trusted traveler programs. CA still allows the Feds access to the CA DMV database for the purpose of approving or denying these trusted traveler programs.
States maintain extensive databases thru their DMVs. These databases include things like fugitive warrants, criminal records, convictions, etc. So while NY residents can still get a passport, they will no longer be able to participate in Trusted Traveler programs. All pending applications for these programs were flushed and refunds are being processed. Further any NY resident who is currently a member of one of these trusted traveler programs will not be allowed to renew.
Air travel really sucks at the 3 NY City area airports and that is just going to get worse. Many people get Pre Check via their Global Entry enrollment. That will go away for NY residents when their Global Entry or NEXUS expires. So yeah, NYC travel is about to get much worse.

I'm not arguing against NY State for having the right to do this. It is disingenuous to claim the Feds are acting in a retaliatory manner in this case. The concept of the Trusted Traveler program is that the traveler is trusted. How can this trust be established without a background check?
