”Pre-emptive” pardons are unconstitutional. There was only one in history before Biden: Richard Nixon. It was controversial and legal scholars doubted it could stand if challenged. It never was.
Pardons are for prosecutions that resulted in a guilty verdict. There are 2 constitutional issues that point to why a pre-emptive pardon cannot withstand constitutional muster:
1. A person is innocent until proven guilty in a court of law. But only a guilty party can be pardoned.
2. Pardons are inherently tied to the legal principle of double jeopardy. Pardons work because a person cannot be tried again for the same crime after a verdict has been reached.
Since there is no verdict prior to a pre-emptive pardon, there is also no principal of double jeopardy protecting the pardoned party from being tried for the crime in question.
For these reasons above, the Trump administration MUST proceed with prosecuting any crimes pre-emptively pardoned by Joe Biden on his way out, and challenge the legitimacy of such pardons on the grounds laid out in this post.

Interesting read, Seer. But if what you assert is true (and it might be - it makes sense), then what is the true scope of the pardon granted by Biden to Hunter? Does it only extend to the two convictions thus far or does it extend to all the other criminal shit he did since 2014? And how does that logic square with Ford's pardon of Nixon? I think a president's power to grant pardons probably exceeds the limitations you have asserted. Would make a good research project.

Pardoning someone before a crime has even been alleged seems a bit risky. Maybe a lot risky. What if the guy is responsible for millions of deaths? What if he defrauded investment accounts and now there are millions of retirees losing their homes and no one knew until after he got a free pass? You want an insurrection? Tell a huge number of people and their families they can't sue to get their lives back. You'll create a level of desperation where taking up arms and dying for a noble cause starts to look like an attractive life goal.
I'm not suggesting any of ^that^ is directly relevant to Hunter Biden but there's a dangerous precedent being set and eventually we could get to a place where frustration with inequity becomes a catalyst for revolution. French style.
