Former Cowboys receiver Irvin arrested


PLANO, Texas (AP) - Former Dallas Cowboys receiver Michael Irvin was charged with misdemeanor possession of drug paraphernalia after police searched his vehicle during a traffic stop, Plano police said Sunday.

Irvin, a semifinalist for the Pro Football Hall of Fame, was arrested on an outstanding warrant for speeding in Irving after being pulled over Friday afternoon for speeding in Plano, the Plano Police Department said. Police spokesman Mike Johnson said he didn’t know what kind of paraphernalia was found.

Irvin paid a fine on the speeding ticket and posted bond on the drug paraphernalia possession charge. He was released about an hour after he was pulled over.

Irvin, a member of three Super Bowl championship teams with the Cowboys, retired in July 2000 and works as a studio analyst for ESPN.

An ESPN spokesman had no immediate comment.

In 1996, Irvin pleaded no contest to felony cocaine possession in exchange for four years of deferred probation, a $10,000 fine and dismissal of misdemeanor marijuana possession charges.

Irvin holds Cowboys records for catches (750), receiving yards (11,904) and 100-yard games (47), including a team-record seven in a row in 1991.

Judge drops drug charge against Michael Irvin

DENTON, Texas (AP) — A judge dismissed a felony drug charge against former Dallas Cowboys receiver Michael Irvin on Monday because prosecutors said an officer conducted a search without a warrant.

State District Judge Lee Gabriel honored a state request dismissing the felony charge of possessing less than a gram of cocaine.

Irvin was indicted in June, 10 months after he and a woman were arrested at a Dallas apartment where law officers said they found marijuana and ecstasy pills. He has insisted the drugs were not his, that he was in the wrong place at the wrong time.

Irvin was to appear in court Friday for a motions hearing in the case. A trial date had been set for Jan. 14.

But a prosecutor said in a motion in court in Denton County that attorneys learned last week that a warrantless search of the apartment had been conducted.

"Until this fact was revealed to the state, the state was under the belief that all of the evidence that the state intended to introduce in the trial of Michael Irvin ... was found in plain view in the apartment when the officers entered the apartment," according to the motion.

The state also said that separate internal affairs investigations of three officers from three law enforcement agencies called into question the testimony of material witnesses. Prosecutors said without that testimony, the state could not present a case against Irvin or Nelly Adham, the woman in the apartment with him who later was indicted on the same charge.

"Our initial reaction is one of great relief," said Peter Ginsberg, one of Irvin's attorneys. "We are glad Michael can go on with his life now."

Prosecutors said they had not been able to question the officer before last week because of an internal investigation involving an unrelated internal affairs investigation.

The district attorney's office could not be reached by telephone for comment Monday night.

Irvin retired in July 2000 and was hired for Fox Sports Net's Sunday pregame show. He lost that job a few weeks later after an initial arrest in the North Dallas apartment case.

Irvin was arrested Aug. 9, 2000, at the apartment where law officers said they found marijuana and other drugs. Authorities said they found less than 2 ounces of marijuana along with ecstasy pills. Irvin was not charged after the arrest. The indictment on the cocaine charge was returned in June.

In 1996, Irvin pleaded no contest to felony cocaine possession in exchange for four years of deferred probation, a $10,000 fine and dismissal of misdemeanor marijuana possession charges.

The NFL suspended Irvin for five games. He finished his deferred probation on the charge just before he announced his retirement.

He was a member of three Super Bowl champion teams with the Cowboys and established himself over 12 seasons as one of the NFL's best receivers.

DALLAS -- Michael Irvin, the former NFL star arrested last week at an apartment where law officers say they found marijuana and other drugs, will not join Fox Sports Net as an analyst.

"After several lengthy conversations between Fox Sports Net and Michael Irvin, both parties agree that given the events of last week, it would be imprudent for Michael to begin his career as an analyst on "NFL This Morning' at this time," the network said in a release Friday.

The network said the show will be hosted by Chris Myers, with analysis from Marv Levy, Jackie Slater and Chris Spielman.

Fox Sports Net officials reached by The Associated Press declined to discuss the announcement further. Irvin, the star receiver who retired from the Dallas Cowboys this year, could not immediately be reached for comment.

Irvin was arrested Aug. 9 at an apartment where law officers say they found less than two ounces of marijuana along with ecstasy pills. He was arrested on investigation of misdemeanor marijuana possession.

Two days after Irvin and another woman were arrested at the north Dallas apartment, members of a drug task force announced they would not seek marijuana charges against Irvin.

A drug task force had a warrant for the apartment's tenant, who was not there. Instead, Irvin and the tenant's sister were at the apartment.

Apartment tenant Ronda Adham was arrested by task force agents on Aug. 10 in a Dallas suburb. She was indicted on federal drug trafficking charges in 1999 and had violated conditions of her pretrial release.

Adham was part of a group accused of selling the heroin that killed former Dallas lineman Mark Tuinei last year, according to published reports.

Irvin has insisted he was in the wrong place at the wrong time and the drugs were not his.
