To be perfectly fair, morality is being legislated by both sides of the aisle. It took Democratic votes to raise the drinking age, legislate smoking out of bars and mandate seat belt usage, just to name a few of the nanny state regulations.

That being said, Phelps is a lot closer to Jerry Falwell than Jesse Jackson. And anyone who says otherwise is a fucking moron.
