Defense Counsel's (XXXL's) Dream Witness

Post by XXXL »

I was in the trenches yesterday, fighting off a beating from the District Attorney's string of witnesses all claiming that my client allegedly poisoned a co-worker. A felony, PC 347(A). I skillfully persuaded a seasoned DA, back from retirement to reduce this to a misdemeanor on the basis that my client scored high on the armed services exams, and BTW, my client is a juvenile, and this is in Juvenile Court. The DA's offer was rejected, I have an innocent client.

To make a long story short, the third witness called to testify that my client made an out of court admission as to guilt on the felony, came out with the dream testimony of all defense lawyers, the witness says the following: "The statement I signed declaring that defendant admitted to the poisoning is not my statement. My manager drafted my statement and made me sign it." She told me that she would add smart words to make it stronger. What I signed is not what happened."

I looked at the Judge, he fell back in his chair, shocked. I looked over at the Detective sitting next to the District Attorney, he seemed embarrased when he looked my way, his head also fell back as he fell back into his chair. Then I looked over at the seasoned DA, who I respect professionally, his head is nodding, oh no!

It was like television, a defense lawyer's dream and I lived it.......

I kind of felt like Tom Cruise when he had Jack Nicholson on the stand.

It was golden and I won't soon forget it.......

BTW, the evidence fabricating manager is a lying sack of ............. :) You know the deal :)

I assume the evidence-frabricating manager isn't going to face charges?

Get this, the Court took a break after the third witness. I went into the lobby, looked over at the DA talking to the manager. It seemed as if she was in a corner, trying to spin the issue.

After the short break, the trial resumed. The DA had to call the manager, she testifies that she couldn't remember what happened. LIAR....... I call it selective memory. Needless to say, the DA quickly finished his direct examination, I drilled her, she continued to claim that she couldn't remember what happened. Yeah, right :)

It got better, the Judge asked her further as to what her role was and how she facilitated the investigation. She played dumb. Lying sack.......

Trial resumes next week. I like my chances better now than yesterday when I figured it as 50/50.......

At least the truth is coming out and I get to stick it to the MAN.......

I'll bet you're an obsessive-compulsive. Your ellipses are always a non-standard, yet consistent length. This is noticeable since you usually only post a few accompanying words (you probably count those too). I'll bet that shit helps dictate the course of your trials.

Rock n roll........
