Should the man and I choose to, we will be exchanging rings and having a ceremony of sorts, but no legal proceedings will take place. My last marriage left me saddled with thousands upon thousands in debt from a husband who didn't know how to handle his money. I'm not going to get stuck with any bullshit like that again, nor do I want to saddle HIM with my shitty credit when the time comes to make major purchases involving financing. Neither of us are religious, "marriage" in its traditional sense means shit. The morality argument is just plain fucking stupid.

All board bullshit aside, Monen brings up a good point. On the other side of the equation, however, I have a client who, right now, is getting put through the ringer because of his situation.
  1. He bought a house with his girlfriend (not his wife).
  2. The relationship didn't work out (surprise, surprise).
  3. She got him out of the house and an Order of Protection against him by bringing some trumped up charges against him (Motion to Dismiss gets heard tomorrow night, from the Judge's earlier comments I'm feeling somewhat good about it).
  4. Meanwhile, the house is now in foreclosure because she didn't pay the mortgage (we're trying to negotiate buying her out and then getting the house out of foreclosure).
I'm not saying marriage would have prevented all of this, but at least, had they been married, there'd be a statutory framework in place to sort this out. As it is, I had to cross-claim for partition in the foreclosure action to keep her from simply letting the house go to foreclosure. But my client certainly doesn't want a partition, just to buy her out. He'd definitely be better off right now had they been married.

Having said that, every situation is different, and there's no one pat answer that's always "right." A pre-nup agreement can offer good protection if there's either heavy assets or heavy debt on one side or the other, or both. But in many cases, it's not necessary.
