When I was in litigation, I did take them on. Step one is to get the case dismissed; if it shouldn't have been filed in the first place, then it should be easy to get it dismissed, right? Not always. Sometimes such suits go all the way to trial, which is really frustrating.

Sanctions against the attorney (and also the client, depending on the circumstances) can be imposed for frivolous pleadings, although it seems that they are rendered more in federal courts than state courts.

I think part of the reason for the discussion here is that the word "frivolous" is defined in a much more narrow manner than the general public thinks it should be. For example, in New York, "frivolous conduct" in the context of litigation is defined as

The rule defines conduct as "frivolous" if: (i) it is completely without merit in law or fact and cannot be supported by a reasonable argument for an extension, modification or reversal of existing law; or (ii) it is undertaken primarily to delay or prolong the resolution of the litigation, or to harass or maliciously injure another.

Note that a pleading, motion or response can also be considered "frivolous" if it asserts a fact which is materially false.

Another matter to consider is that the sanctions for frivolous conduct applies not only to the action as a whole, but to conduct within the litigation. So it's possible for a party to be sanctioned for frivolous conduct even where the underlying action or defense asserted by the party is not frivolous in and of itself.
