Gas efficiency is not the problem for me, commuting distance is. I get about 30 mpg. But living about 40 miles away from where you work sucks.

Throw in the fact that I often have to go to courts in other places, sometimes pretty far-flung from one another. According to mapquest, I put about 200 miles on my sled yesterday.

when I originally bought my ride, gas prices were below $2/gal....even if I tried to sell it (which Mrs. Felix is in favor of but will never happen unless I move up to something that guzzles even more gas) I'm guessing that I probably wouldn't get as much for it now as I would have last year.....

Two of the four were assigned -- I can't bill them. I get paid for my services by the county in question, but not until after the case is completed. And only one of the two counties pays for travel time. Granted, that one alone will pay for the gas I spent, but I won't see that money for at least another two months or so.

As for the others, I charged one a flat fee which he paid over a year ago (then bothered not to show up for court). The other is a child support case. My client makes poverty level income. I took the case basically because I felt sorry for him. He's paid me something (not nearly enough), but you can't get blood out of a stone.

Since you mentioned the new Bankruptcy laws quite a bit, and I probably have a little more knowledge on that point than most in here, allow me to chime in.

To come totally correct, the effect of the new Bankruptcy laws in forcing Chapter 13 filings which, in the past, would have been Chapter 7's, has not been nearly as dire as I first thought it would be. Then again, there are a few points to consider germane to my practice in that regard. First, I live in the Western District of New York. At least so far, the Courts have held that application of the means test is triggered only when the Debtor's income exceeds the state median income for a household of comparable size. In my neck of the woods, at least, debtors benefit in this regard from the fact that the cost of living in the NYC area, which is still a part of the same state, means a resultant spike in statewide median income. In other words, the median income in this area is appreciably lower than the median statewide income, so you could have a debtor whose income is above the median for this area but below the state median, and who therefore is not subject to the Chapter 7 means test. Second, even under the old laws, the U.S. Trustee's Office in this area was rather aggressive in using the substantial abuse provision to force higher income debtors into Chapter 13. Here's one example.

Having said that, I'm no fan of the new bankruptcy laws, nor have I ever been one. And the new bankruptcy laws have certainly had an effect, albeit a backdoor one. Fewer bankruptcy cases are filed now than in the past, but not because the need for bankruptcy has diminished. It's because filing a bankruptcy case has become more onerous. And there are a lot of new traps for bankruptcy attorneys that were not there before, which has caused more than a few attorneys to get out of the field of bankruptcy altogether (I would be in that group as well, but unfortunately, I don't get to call those shots at my firm). I don't mean to go Nick Frisco, but I have a hard time believing that effect has been entirely unintentional.
