The Times sues contending that Trump's mention of the program de facto declassified it making it subject to FOIA request.

Let that marinate in your diseased brain for a bit. The Times is contending that the mere mention of a classified program by POTUS is sufficient to declassify the program. Gosh, that seems to imply that POTUS has the authority to declassify anyfuckingthing that he wants.

The court agrees that POTUS has that authority, but that the oblique mention of a classified program on Twitter is not sufficient to declassify it. They further state that POTUS' authority on that subject is not subject to Congressional review or protocol. POTUS decides what the "protocol" is as chief executive and CiC of the United States. It is similar to the power of POTUS to pardon anyone convicted of a federal crime for anyfucking reason that he wants.
