I've already got Dinspedia's 2 cents on the subject in a different forum. Looking for someone who is licensed or deals with this on a normal basis. My realtor is also the listing agent so there is somewhat a conflict of interest.

Seems pretty simple to me. You cannot have that realtor representing you. And quite frankly, if I were considering a purchase of that magnitude I would not be represented by a realtor, I’d have an attorney experienced in real estate transactions. Just my 3 cents worth.

Heaven forbid you use someone who spends all day every day dealing with real estate transactions, and has probably completed more transactions in the last year than the attorney has in his life.

As a purchaser, you lose nothing by having a realtor. The seller pays the fees. Duh.

And actually, my bestest buddy and former (and occasionally current) business partner is a real estate broker (I occasionally end up doing renovations on some of the properties). And he represents both sides of a deal quite frequently. And he's never been so much accused of any conflict of interset. That stuff goes on all day every day all across the country. 'Round these parts, if an agent represents both sides, and tries to strongarm someone into purchasing one of their own listings, the state board is on them like stink on shit, and once that license gets suspended, they don't give it back, ever.

If it's a friend of yours, IF, I doubt the conflict of interest is an issue. If you don't come up with any help here, I could probably talk an experienced agent into talking to you... probably for the low, low price of a jar of Brent's.

I said an attorney experienced in real estate transactions. This is a suggestion I got from the head of mortgage banking where I bank. But yes, I’m sure you know more about the business than he does, you tedious gasbag.

Yes, our agent is a family friend. She's fucking loaded, but this house is one of her big earners. She sells houses like this 3-4 times a year I would guess round these parts. One of my best friends just opened an agency, but, as Goobs said, a house of this magnitude, I'd rather have the person who has been selling homes for 30 years who I do not know as well vs. a friend that just opened his business this year. I hate not giving him the business as he would bank pretty good on it, but my dollar is more important to me than my dollar is to him.

In any case, my reltor is selling this house for the secodn time in 2 years so she's probably not going to give us too much issue on the lowball offer we plan to put down today. And us offering up nearly 100k in earnest should be enough to let the relo company know we're definitely interested in the property.

Nothing like a good ol' fashioned cripple fight to start a Friday Morning.

In case you haven't figured it out yet, corky, he's already settled on a house. In another forum, everyone but you agreed that it looked like an excellent value at Indy's desired price point. He's preparing to make an offer. You know, the legal papers. BTW, I have access to the basic data in the MLS.

Dual Agency is only legal in a couple of states these days.

There are three kinds of Agency predominantly in use today: Seller Agency, Buyer Agency and Transaction Broker. The Seller agent represents the seller and only the seller; the Buyer Agent represents the buyer and only the buyer; and the Transaction Broker only facilitates the transaction and doesn't specifically represent anybody.

From the Selling Agent's point of view, a buyer who comes to him or her and who isn't represented by a Buyer's Agent is called a CUSTOMER. From the buyer's point of view, being a CUSTOMER is just about the last fucking thing you want to be. Other than not lie to you, the Selling Agent owes no fucking obligation to your interests. Far better to be represented by a Buyer's Agent who DOES have an obligation to you. And it doesn't cost you a fucking dime because the selling agent offers a commission split to get other Realtors® to show his listings to their clients.

I did not know this. My buddy ends up with double-enders on an occasion. It's a nice paycheck, but it's double the work, and often twice the pain in the ass, so not really some major financial boon.

That's not Dual Agency. Dual Agency is representing both parties interests equally- something that's nearly impossible to do (i.e. prove you've done) What he's probably doing is representing the seller & treating the buyer as a customer. Nothing unethical in that, but the buyer needs to know that his interests aren't being represented. It's also not that great a deal financially for the agent since it's pretty common to have a significantly reduced commission in that situation. (e.g. 3% instead of 6%) You usually make out better paying a buyer's agent 2.8% and keeping the 3.2% that's left over

Double-Ending a deal is usually where you sell your client's house and then represent them as a buyer's agent on their new house- and that IS a pretty deece paycheck.

Not my gig, so I don't care all that much, but I know he's had buyers that he's taken on, who end up buying his listings. I think here anyway, as long as he makes it clear he's the listing agent, it's not an issue.


I KNOW this has happened (I've been working on at least one of the houses at the time). And I KNOW he don't cut it down to no 3%, although I think the buyer ends up with one hell of a housewarming "gift" out of the deal.

Exactly. That's why I didn't claim to have access to the MLS, jsut some of the basic data (number of bedrooms, bathrooms square footage, etc.) When you get a chance, please explain it to Cooter.

This whole discussion about the property Indy is looking at started in the Cooking Forum. The house was built like 6 years ago for $965,000, Indy’s talking about possibly being able to buy it for about two-thirds of that amount. He’s already consulted with his realtor buddy who’s coincidentally the listing agent. I believe it has been determined to be a very good value at that price. The only thing he has left to do is make the offer/do the paperwork
