Ex-Chargers LB Foley will settle lawsuit for $5.5M

SAN DIEGO (AP) — Former Chargers linebacker Steve Foley has agreed to settle his lawsuit for $5.5 million against a police officer who shot him while off-duty two years ago, ending his pro football career.

Foley struck the agreement with the city of Coronado and Officer Aaron Mansker last week, on the day he was scheduled to testify in his civil trial in San Diego Superior Court, but the terms were not released until Monday.

"He's going to be able to get on with his life and bring some closure," said Foley's attorney Harvey Levine.

The Coronado City Council approved the settlement Monday, said Mayor Tom Smisek.

The city, an upscale peninsular enclave on San Diego Bay, will pay the entire $5.5 million, Smisek said. Insurance will cover all but $100,000, which will come out of city coffers.

City Attorney Steve Boehmer, who represents the city and Mansker, did not respond to a phone message.

Foley, 32, was shot in his leg, hip and hand in September 2006 after Mansker tailed his car home from downtown San Diego to suburban Poway, 15 miles north, on suspicion that the driver was drunk.

Mansker, then a 23-year-old rookie officer, was driving his personal car and wearing a T-shirt and jeans when he twice pulled up next to Foley and ordered the player to pull over. Foley ignored the orders and drove home because Mansker didn't identify himself as a police officer, Levine said during the trial.

The two men confronted one another in Foley's cul-de-sac. Mansker testified at the trial that he fired when he saw Foley reach for his waistband, thinking the player had a gun.

Foley pleaded guilty in 2007 to misdemeanor drunken driving.

He was released two years early from his contract with the Chargers in March 2007 and has moved to Houston, where he is caring for his 11-year-old daughter and plans to complete his college degree, Levine said.

Mansker was cleared of criminal liability after the San Diego County district attorney's office found he shot in self-defense. Mansker was honored by Mothers Against Drunk Driving at a luncheon in March for making 57 drunken driving arrests in 2007.

And BTW, the week before the shooting (just coincidence, I'm sure...)

On Sunday, the sheriff's department issued a statement that Foley's car, driven by his friend, had been driving erratically, "weaving at high speeds." The statement failed to mention just how Mansker happened to be in position to follow Foley and why he didn't so much as send a smoke signal for assistance. The statement also didn't address Foley's recent - and scalding - history with the San Diego police force. In April, police arrested Foley for multiple crimes including resisting arrest, battery of an officer, and public intoxication. Last week, the DA dropped the case and cleared him of all charges. And now Foley's shot. "Stinks like a beached whale"? More like a beached Bull Connor.

Jacob Richard Faust


Jacob grew up in the San Diego area. He was very quiet as a child, but had a constant twinkle in his eyes and a blinding smile. He always loved a good practical joke, and had a magical sense of humor. Jake spent his high school years playing guitar in a worship band at Horizon Christian Fellowship and also spent that time counseling kids for Youth Development International, a suicide prevention hot line. He was given the Phillip Award for discipleship at Horizon High School where he graduated in 1998. Jake loved people and always looked at the world through eyes of wonder and astonishment. He had the heart of a poet and the eyes of a seer.

Jacob's passion was music, and he could play any instrument he picked up. His most cherished possession was a 1903 pump organ on which he composed many pieces. He would put it in the back of his van and haul it to any place someone would allow him an audience. He loved a wide variety of music, with favorites including Django Reinhardt and Tom Waits. He also loved to dance and could move as gracefully or as comically as he chose to at any given moment.

He was a former funeral director at Glen Abbey Mortuary, where he was well known and served people with a heart of compassion. Jacob was a gentle man, an amazingly talented dancer, writer, and actor with an incredibly sweet disposition and a smile always ready. He was well read and followed current events with a keen interest.

On April 4, 2005, Jacob Faust was shot to death by San Diego Police Officer Keaton ID 4495 and Officer Holliday ID 5030 after a "routine" traffic stop for apparent unwillingness to get out of his van. He was 25. Jake had previously witnessed and been exposed to harassment and abuse by the San Diego Police Department and had filed a complaint against them just a few weeks before. The Internal Affairs division had been investigating this in the weeks prior to his murder. Jacob was a pacifist. He had no criminal history.

Maybe he should have gotten out of his fucking van. People......if the cops tell you to do something...especially here in town, then fucking do it. And double especially if you're somewhere like IN YOUR VAN where they can't see your hands

The courts found that Foley had absolutely NO reason to believe Mansker was a cop, that's a completely different scenario. We're talking uniformed officers here, not some renegade cop that can't follow his own department's rules for drunk drivers and costs his city $5.5 million in damages

True. But that case did change the rules regarding under what circumstances you need to comply with an officer's order to pull over and get out of your vehicle.

Yes....which is why Coronado just had to pay out Steve Foley, but the majority of shootings happen because idiots reach into their pockets (for whatever....cellphone, lighter...crackpipe, whatever...doesn't matter) with a stressed cop screaming at them to put their hands in the air, or they run their vehicle in the direction of the cop, or pull a knife during a gunfight in which case the liberals try to insist that the cop didn't need to use lethal force. Penn was a POS and good fucking riddance to him finally having the decency to off himself a few years back.....and let's not forget, he shot Jacobs AND the unarmed lady who was in the car as a ride along.

Actually it was Bobby Riggs who got shot and killed.

But it was right after his getting over that SD adopted the shoot first, ignore later policy.
