About a month ago I sold a used car a 1999 Ford Escort to an acquaintance. I've had this old car pretty much just sitting around for the last year. I would get it out of the garage and drive it about once every couple of weeks and that is about all. It has about 135,000 miles on it and is in decent condition. This acquaintance wanted a car for his son who is 18 and I sold him this Escort for $2,000 cash. We didn't make any written agreement at all. I just signed the title over to him and he took the car as it is.

After he had the car for one week it had an engine problem. He took it to the shop and they quoted him a $650 cost to fix things. Now he is saying that this was a "preexisting condition" and he wants me to foot this bill. I told him I was sorry for the problem but he bought the car as it is and it's his responsibility now. He wasn't happy with my answer and said he would take me to court if I don't step up and do right by paying for the repairs. He said if I make this repair he will consider everything even and won't pursue any more from me in the event that the car needs more repairs soon.

Does he have any basis for expecting me to pay for the repairs? I don't want to get into a big problem with this man, but it seems to me that it's his problem now. When he bought the car he looked it over but declined to take it to a shop to get it looked at prior to buying it. He felt it was in good condition and bought it from me.

Any legal experience of input is appreciated. Thanks.

By the way it is less than two weeks until my wife and I go on our relationship workshop weekend. I'll give an update for you after it is finished on July 27th. I'm not looking forward to it much but I'm sure I can live through it.

Check your state for lemon laws. In Texas however, that repair is on him.

Hopefully, now though you understand the importance of a sheet of paper signed by both of you saying as is and the amount paid.

Dan, I'm not sure what your legal options are, but can't you just call him and coax him politely into understanding your side of the story? If he won't play along, offer him a crack at your wife's dimehole...that is, if the stitches have healed.

I had a Mercury Tracer (Escort with a different nameplate) for 9 years. Put 175k on the ride and it was running like a champ and still getting 28 mpg when I traded it in. If I didn't need something to haul larger loads, I might still be running the car.

That "chick car" went through hell and back and laughed at the debris along the way. I drove that thing through 115 degree desert heat and 2 foot snowfalls and never once did the Tracer bog down, overheat or otherwise break down. It's the best built 4 cylinder car I've ever seen by far.

sounds like one of the old tracers. My little sis had one, her first new car. It is a rebadged mazda 323 built is meheeeco. It was a great fukking car. Much better than any escort I ever saw.

It was a 1995 Tracer. It looked exactly like this 94 model.

Escorts/Tracers are hardly "chick" cars. They're practical starter vehicles for high school kids, and college students especially. I had a white escort when I turned 17 and it treated me great.

I don't know how it is in the Goober household, but we don't all get handed keys to a brand new BMW the day we get out driver's licenses.

The early- to mid-90’s Tracers were built on the Mazda platform. Some got Mazda engines, some got Ford engines. With 135,000 relatively trouble-free miles, you must have had the Mazda power plant.

My first car was Nissan PL411 (1965 - before Nissan became Datsun before they became Nissan again). Looked something like this, but forest green with two wide white stripes running from front to rear on the hood, roof and trunk:

A massive 1299cc four banger, four on the floor and no radio.

I learned to drive in my mom's muscle car. This color but no custom wheels. Pretty innocuous looking but the 318 cid engine made it pretty damn fast.

sorry charlie, but 318s are not muscle cars. 318s are what mom gets because they didn't offer A/C with the 6 cylinder version. That was my grandpa's excuse for getting a 302 in his new '73 maverick.

Here's a pretty good rule. If the first number for the engine is not 4 and it is not a 396, then it pretty likely is not a muscle car.

Not sure I agree on the 318 not being a muscle car engine. It was the standard power plant in the ’68-'70 Dodge Chargers

Yup, it was a '65.

OK so the 318 wasn't a huge powerplant but it would readily smoke the tires at a stoplight.

And it did look like something your grandma might drive (my grandma had a Dodge Dart which, I think, was basically the same machine).

As Lefty said, check the lemon laws in your state. My guess is that if you are not a dealer, they don't apply to you, and you aren't responsible for the repairs.

No doubt it would be a fun car. Just not quite a muscle car. Hard to believe that chrysler actually had the nerve to stuff a big block hemi in those things for awhile. Now that would be a muscle car.

Couple weeks ago I flushed the radiator and the fuel system on my Shaftmobile. I noticed the gas mileage is better. I just put four new tires on it yesterday. I'm gonna drive that thing until it has a stroke and dies.

Thank you to those who have offered me advice in this thread. Left Seater, Terry in Crapchester, Q West Coast Style and Jsc810. I appreciate it. As it stands right now I have offered the buyer that I will pay for half of the repairs to the car he bought from me. I made that offer to him two days ago after we had gone back and forth for a while debating this thing. He accused me of selling him a broken car on purpose and I've said over and over to him that I am not that kind of person. I'm waiting to see if he takes my offer. If not I guess he'll just have to sue me if he thinks that is what he needs to do. I'm sick of it.

I am taking the afternoon off work tomorrow to get ready to go to the relationship workshop with my wife. We'll be back on Sunday night. I'll be happy to give you an update. I hope it goes well and I hope my wife gets what she wants out of the experience.
