St. Joseph County prosecutors have received a police report from Notre Dame involving an allegation of a sexual attack by a football player more than two months ago, officials said today.

Prosecutor Michael Dvorak said campus police forwarded a "voluminous" report to his office on Friday but that he was unaware of it until Sunday, when the Tribune published a story detailing the university's handling of the case.

Elizabeth Seeburg Allegations
South Bend, IN-The following statement is made in response to multiple media inquiries following a Chicago Tribune report, which speculated about an allegation of a sexual assault made by a St. Mary's College student prior to her death:

Elizabeth Seeburg made a report to the Notre Dame Police Department regarding an allegation of sexual battery by a Notre Dame student, occurring on or about August 31,
2010. Upon receiving the report, the Notre Dame Security Police Department initiated an investigation. Ms. Seeburg died on September 10, 2010.

After Ms. Seeburg's death, the Notre Dame Security Police Department (NDSPD) investigators assigned to the investigation of her sexual battery complaint contacted the St. Joseph County Special Victims Unit (SVU) to advise them of the pending investigation. NDSPD has kept staff members of the SVUinformed throughout the investigation. The St. Joseph County Special Victims Unit (SVU) is a multi-jurisdictional investigative unit
comprised of detectives from the South Bend, St. Joseph County, and Mishawaka Police Departments, which investigates reports of alleged sexual battery jassault, domestic violence, or child victimization. These three departments contribute officers to the SVU, which serve under the command of an Investigator from the St. Joseph County Prosecutor's Office.

The Notre Dame Security Police Department is a fully authorized, independent law enforcement agency. While there was no request by NDSPD to avail themselves of the
investigators with the SVU,NDSPD does not contribute officers to the SVUand has the independent authority to conduct its own investigations into criminal allegations.
NDSPD employs trained police officers that have significant experience in law enforcement positions with agencies such as the South Bend Police and Federal Bureau of Investigation. They have in the past taken care to conduct thorough investigations of criminal allegations,
and have compiled complete reports of their findings, forwarded to this office.

An NDSPD investigation concerning allegations made by Ms. Seeburg, has been completed and forwarded to the St. Joseph County Prosecutor's Office just last week. The investigative report and attached documents are under review at this time. The Prosecutor's Office will make a statement after the review is completed to advise the public, via the media, as to the next step in the process: the filing of charges, the decision not to file charges, or a request for additional investigation of the allegations.

At this time, I wish to emphasize that cases involving such allegations are complex and it would be inappropriate to rush to conclusions, rather than allowing the thorough review by prosecutors to occur in this matter.
