A Texas father has been charged with murder in the fatal shooting of a suspected drunk driver who authorities say killed his two sons.
David Barajas, 31, and his sons were just yards from their Houston-area home Dec. 7 when a car struck them, The Associated Press reported.
David Jr., 12, died at the scene while Caleb, 11, died later at a hospital.
Barajas and his sons were pushing the family's disabled pickup truck down a dark, rural road with the boys' mother and two younger siblings inside, ABC News reported.
They were struck by 20-year-old Jose Banda, who was intoxicated at the time, police said.
Neighbors reported hearing gunshots minutes after the crash, and Banda was later found shot in the head, CBS News reported.
Witnesses said they saw Barajas walk to his house shortly after the crash and then return
Authorities haven't found the murder weapon, but told the AP they did find the same ammunition that killed Banda at Barajas' house.
Officials are waiting for results of DNA and gunshot residue tests, the Houston Chronicle reported.

I would want to know more about the situation.
Were the trucks flashers on? Did dude have a few drinks or was he hammered?
No way the dad goes down on murder 1 charges, but, depending on the facts he prolly needs to do some time.
If you are gonna push your fukking truck down the road in the dark, you might want to get the fukk out of the way when any traffic approaches.

not quite that cut and dry.
if these knuckleheads were blocking the lights in dark clothing as they likely were, you'd be right on top them before you saw them on an unlit road. of course having a BAC pretty much puts all the fault on you. not that this dude is much worried as he is kinda dead.

this is a good reason to have bird shot in your shotgun, that first shot will put him down and spaghetti monster forbid you shot the wrong dude, their is a pretty good chance he can be patched up. have a round of 00 buck behind it though, so you can finish the job if you shot the right dude.

Yeah..the mask, charging him and the knife pretty much says the right dude. That it was his 15 year old son is sad, but 15 year olds don't belong running around the neighborhood all ninjaed out at 1 am. That pretty much screams criminal activity.
Think about the distance thing here. If he is close enough to charge you inside of 25 feet, you will not be able to get a shot off. If you shoot him with even birdshot at that range, dude is going to have a dinner plate sized hole in him and be very dead. Why bother?
My shot gun is loaded with 00 buck from start to finish. The idea that you can use bird shot in a shot gun as an effective defensive round to reduce collateral damage is complete bullshit.

Point blank, yeah the birdshot will kill him, but at at 10 ft, it may not. I assume dick cheney was pretty close to his buddy when he blasted him and dude was fine. the birdshot will slow the person down long enough to chamber something a little more potent.

At 10 feet a load of birdshot is going to be about 3 inches in diameter max with one hell of a bunch of force behind it. Enough to cause aorta detachment, chest compression, knock them flat on their ass, with pellets penetrating the heart and lungs. Fucking dead.
