Expect no charges. This is Ontario County. What you can expect is jack squat. The kid should have stayed in his rode and waited for a tow.

I haven't heard what Tony has to say yet so will reserve judgement. Regardless, the kid should not have been walking down the track into the racing groove after an incident. Intentions aside, that's asking for trouble.

Poor judgement by a young rookie. Thinking Tony did it on purpose or was just trying to scare the kid is absurd. An unforunate accident and Tony won't be charged with anything.

He's always been a prick. Saying that, he was following another car #45 and looks like he tried to swerve at the last second to miss the "wannabe" tough guy while in poor lighting. As Brian says... Darwin.

He hit him with his right rear tire, which suggests he was trying to avoid, not "run over" as the thread title suggests.
Say what you will about Tony being a prick but he's a race car drivers driver. He loves racing so much he goes and runs dirt tracks as a hobby in between NASCAR events. This, after he broke his fucking leg running a dirt track in Newton Iowa last year, almost to the day.
Word to Tony - take August off from now on.

I'm no Moving Sale, or even Barnaby Jones, but it looks like it might be difficult to prove beyond a reasonable doubt that Stewart's negligence caused the death.
Just for starters, does anyone know if these drivers are ever given a set of written "rules and/or standards" which advises them to stay in their car -- and not go out onto the track, unless the car is on fire?

The kid never should have left his car. The car ahead of Stewart had to swerve to avoid him. I don't believe any charges will be filed.

That could be used to bolster the states' case, but without him saying something about buzzing people or the like it would be a very hard case to bring.

Exactly. The kid was going to try and build his racing cred with his boys by going out and fucking with Stewart because Stewart bumped him when he was too high to do anything anyway. If not Stewart, somebody else would have done it. 20 year old sprint car driver going to fuck up a veteran 43 year old NASCAR driver for putting him into the wall ???? ...
Go up to him in the pits and watch Stewart mash him in the chops then. If this is any other driver than Stewart, this incident never makes the news and the drivers friends go on a week long drunk in his memory.

I sure think it's possible that Stewart intended to "buzz" Ward, but think that in a courtroom, there could be a number of ways he could rationalize the incident -- and especially in light of the fact that Ward chose to get out of his car and dick around out on the track that way.

I don't know if this track or race association had such rules but at least one track does.
From the WISSOTA 2012 rule book:
1.11.2 Assault/Abuse of Officials/Participants and minor unsportsmanlike actions No participant shall engage in improper behavior on or off the track, in or out of the race car, nor shall he or she subject any WISSOTA official, track official, track employee, sponsor, or participant to any abusive or improper language at any time. Any driver who gets out of his/her race car, or any participant who verbally assaults or threaten any WISSOTA official, track official, track employee, sponsor or another participant may be suspended for up to two weeks from the date of infraction, may be fined up to $500.00 and may lose all WISSOTA points (both national and track points). Loss of points are at the discretion of the track officials and based on the severity of the violation.
Any violation of this rule is a non-appealable offense

I'm sure Stewart could have done more to avoid the kid, but running towards an open wheel race car on the dirt under questionable lighting is a perfect formula for injury or death.

Standing in the freeway is stupid but if you can miss the person in the road and you try and buzz them and instead hit them when you could have missed them like the other drivers on the road did then that is a crime.

I have a client that was drunk driving and didn't mean to kill anyone back in the day. He has done 30 years so far. The question is did Tony do something reckless (or worse) that caused the death.

No shit. Last year there was a guy here who took out a jogger. He was drunk, speeding and probably texting. They threw the book at him. He got 7 years.

I know shit about auto racing, but what the hell is a NASCAR driver doing racing at a track that is just slightly better than a rutted dirt road.....we have one of those type tracks here and a NASCAR driver is the last guy I'd expect to see there.....although to be honest, Davey Hamilton who raced for a few years in Indy cars used to drive winged sprints out there.....but not after he started driving open wheel......

Tony Stewart grew up racing open wheel cars. He owns one of those dirt tracks, and has continued to drive those cars even after he made it big in NASCAR. It's what he does for fun, like you or I playing golf.
