You're correct that the one who draws first has the tactical advantage, and if they choose to shoot first they can win the battle. But that ability to hit the broad side of a public housing project is a big factor in actually winning the battle. Officers train & qualify on a regular basis, giving them the advantage of experience & muscle memory. The thug probably rarely, if ever, sees the inside of a range. And I can tell you that there's a world of difference in shooting at someone trying to do the same to you versus shooting at paper targets. That's where a lot of officers are able to take out the trash when being drawn on first.

Hands become paws at a certain heart rate. This applies to both cops and criminals, but police regularly train to offset the adrenaline rush and physiological effects of buck fever. Doesn't always pay off, but it definitely gives them a distinct advantage when they go weapons-free.
