Jared Fogle's ex-wife sues Subway, alleging it failed to alert authorities he was pedophile

Katie McLaughlin divorced Fogle after he pleaded guilty to federal charges of child pornography and having sex with minors. She alleges in the suit that she and her children suffered emotional distress because Fogle's behavior did not become publicly known before she married him in 2010.

"A responsible corporation would take immediate action when hearing of this behavior, even if it was only allegations," she charges in the suit. "Subway failed every test of corporate responsibility in its response to each of these complaints."

The suit contends that Subway believed that sustaining and expanding its market share, profitability and growth depended on Jared's reputation. "Subway's ambition for sales and growth came at the expense of Katie [and her children]," it says.

At a press conference Monday, McLaughlin said it was "beyond comprehension" to find out that her husband was a child predator, and to also learn that executives had been told of his behavior and did not act. With her voice breaking, she apologized to Fogle's victims and said she was filing the suit to get answers about what Subway knew and when its executives knew it.

"A lot of questions have come up, questions my kids are going to ask my some day," she said. "I will not lie to my kids and I want to be able to answer those questions." She said the suit was the only way she could get those answers.

Subway said it could not comment on pending litigation.

The suit details an instance when a Subway franchisee, Cindy Mills, called the company's then-CEO Jeff Moody in 2008, to alert him about Fogle. She said that Fogle had told her that "he really liked them young," and that he admitted to her that he had had sex with minors from ages 9 to 16.

The suit charges that Moody interrupted Mills and told her "Please don't tell me any more. Don't worry, he has met someone. She is a teacher and he seems to love her very much, and we think she will keep him grounded." Moody told Mills that he had dealt with similar complaints in the past.

The suit says that the teacher that Moody was referring to is in fact McLaughlin.

"Having neither expert knowledge of pedophiles' predatory compulsions nor seeking guidance from experts, Subway made a terribly misguided assumption that Jared's marrying Katie would correct Jared's pedophilia behavior," the suit charges.

The suit also details how Subway subsequently started a campaign to battle childhood obesity that entailed having Fogle visiting elementary schools. It alleges that the company started a campaign depicting Fogle as a family man and used images of McLaughlin and their children without her proper authorization.

Fogle is serving more than 15 years in federal prison. He also agreed to pay 14 of his victims $100,000 each.

The suit asks for compensation for "intentional infliction of emotional distress," but doesn't specify a dollar amount.

So, it's her contention that because somebody called her husband-to-be's employer and made unconfirmed allegations that Fogle said something completely unsubstantiated about how he "likes them young," without ever saying he acted on it, dude's employer was supposed to call her (a person who wasn't even related to Fogle at the time) and report it?


That's about as valid a case as Fogle suing his victim's parents for being such bad parents that he was able to rape their child (which in case you missed it, is exactly what he's doing).

So to recap......we have a company who allegedly chooses to do nothing about their spokesperson fucking children because they feared a negative impact on business and image.....but we are going to call out the ex wife for being all about the money? Got it.

But my point remains -- exactly what corroboration did they have besides a person who may or may not have had an ulterior motive (the fact her assertions proved correct is moot)?

They should have called the chick he was dating to tell her that someone said that he said something inappropriate and possibly criminal?

Should they have called his parents, too? His neighbors? Anyone else they had a legal responsibility to pass rumors along to?

If a coworker of yours claims you said you did **something illegal**, should they immediately call your wife? Your parents? Your kids?

I'm certainly not defending Fogle, but I can't see where Subway has any responsibility to inform an employee's friends about rumors that are circulating about that employee -- in fact, it sounds like an extremely dangerous precedent. Her lack of character judgement is hers and hers alone.

It wasn't that hard for me to figure out the point that execs knew about what Fogle was doing long before their courtship. Do they have a legal obligation to tell her? Of course not. Is it the company's legal obligation to alert authorities when they have an employee potentially endangering children? I don't know, but I imagine I would find out if I followed this past today (which i prolly won't).

I just find it interesting that Subway potentially covers up Fogles kiddy fucking for monetary reasons, but people here first question the motives of his wife. Which one of the two entities is the bigger snake in the grass?

I just wish the one behind my house was still open 24 hours, since the only time I consider eating there is when it's late and I'm too drunk to drive anywhere else (and there's a couple of dozen places to eat within walking distance for me, but few open in the wee hours).

Depends on when she divorced him and why. Suing is like saying she had no idea he was fucking children or thinking about fucking children, so don't sue her herself.

As for Subway, that's what morality clauses are for. Did he really screw children or did he only talk about it to a chick who wasn't his wife? If he was telling the chick that, what had he told his girlfriend/wife?

I'm with Dins on this. Subway definitely should have dropped the dime on that POS long ago, but they were not hired by this bitch to be a prospective spouse vetter. That is her job.

If Subway is to be writing any checks, it should be to his victims if they can show that he assaulted them after Subway knew what he was up to.

I live in a nice but modest house, thank you very much... that just happens to back up to an extremely busy business highway. But the tweekers generally stay on the highway... which is nice. Haven't had to shoot one yet.

And the nearest check cashing place is at least 2-3 blocks away.

And people do in fact grow palmettos around here... extremely slowly. While severe cold snaps aren't a regular occurrence here, they can happen. I believe until they're well-established, people wrap the trunk in plastic in the dead of winter. An extreme cold snap will do in a young palmetto, while the older ones seem to deal with it fine.
