Terrorist or not a terrorist?

In short, this Canadian guy takes his American wife to Afghanistan five years ago on a hiking trip and gets caught by the Taliban. At the time it was put out publicly that they were world tourists and ala Otto Warbierer, decided to visit an incredibly dangerous country for kicks and grins.
Five years later, a Paki op occurs and they are freed, but the husband doesn't want to go to the US because he is afraid he'll get waterboarded in Gitmo. Why? Because his first wife was the sister of an AQ top financier and this may be perceived as having ties to terror organizations.
This is interesting for a number of reasons, one being the story being put now is different from what was issued five years ago under the Obama administration, ala Bowe Bergdall. Second, this guy was connected enough to meet with and eventually marry the sister of a high level AQ member and woo him into giving her away into marriage to a fellow Muzzie. I'd note that in that part of the world dudes don't just go to the local bar where they serve goats' milk and pick up chicks clad in what looks like bowling pin attire. This was an arranged marriage which requires connections. Third, he willingly and knowingly subjected his wife to rape and his baby daughter to murder. You don't mess with the Tallies in their backyard as an American or Canadian and not suffer the consequences. Fourth, he's a Muslim, which is to terror and violence what illegal immigrants are to picking tomatoes and melons.
I'm of the mind he's either a terrorist or the unluckiest Muslim version of Forrest Gump where he just fell into terrible circumstances and got caught up in events beyond his control.
Nah, he's a terrorist. Break out the spine board, straps, towel, and bucket. It's time to learn what he knows.
