Testimony was given that people walking into the wrong apartment is a common occurrence in this complex. I suspect it is generally caused by people being cell phone zombies. This was likely the case here.

She MISTAKENLY walked into the wrong apartment.

Dude likely thought she was an intruder and decided to take her out. She thought he was attacking her.

Whether he was balck white or purple didn't matter. She saw someone a good bit larger than her coming towards her in what she took to be a threatening manner. She pulled her gun and shot him.

It was a tragic mistake.

She should never carry a weapon again.

But she shouldn't spend her life in jail either.

It'll go to re-trial. She will be found guilty of some form of manslaughter. She'll prolly walk out with time served.

I would like to see a judgement against her to the family of the victim. Let her get her ass to work as a bank teller or at starbucks so she can pay the poor mother of the man she killed. This won't happen with her sitting in prison.

Sounds like you did your job and the DA agreed with it. Or at least the jury did.

Your client goofed up. He paid a reasonable price for his goof up.

No one is arguing she didn’t fukk up in a major way.

I will take responsibility for saying house, but they are cookie cutter houses with two doors and sold as condos. The point being they are easily mistaken.
He did fuck up which is why he plead to the 602. That’s the whole point. You fuck up you pay and as long as you fucked up in a legal sense then it’s the legal system that decides the punishment. In my guy’s case a 602, in her case a murder rap.

As a side note (and at the risk of burying the lead) the home owner was deer hunting when he saw some quail and switched to bird shot before he got home and put his shotgun by the bed or my guy would have a deer slug in him and not the few birds shot pellets he ended up with that made it thru the side door and if that happened I probably would not have had a client in the first place.

I don’t know how her attorneys handled the negotiations with the DA if there were any, but I would have pushed for manslaughter if I came in after the indictment for murder. As an aside, I have sat through many victim impact statements and many of them were next of kin to murder victims. We don’t get the likes of Brandt Jean very often so they stand out when we do. Gwen Araujo’s Mom Sylvia was one of those exceptions. Very powerful lady, lots of respect for her.

Brandt Jean is a hero.

If his poor brother was similar, and all indications are that he was, this is especially tragic.

Assuming she does get out in 5, I think that's pretty fair. I would have perfered 5 years for manslaughter, but I guess thats not what's really important.

It was probably appropriate that the judge gave her a hug and a bible after sentencing her. Because men who get convicted of horribly violent crimes usually get goodbye hugs from judges too.
