Maybe so. Technically, he's right, in a sense -- you don't need DNA evidence to prosecute a rape case from a legal perspective. But once a jury finds out about the DNA test, his case goes bye-bye for all intents and purposes. I don't think he'd want to subject himself to that.

she would not be the one on trial in the first trial.
they would be.

And charge them with what?

Unless there is evidence that proves a person committed a crime w/o doubt, nobody should be forced to go through the costly & trying experience of a court trial. Otherwise we're just lowering ourselves to vigilantism. I don't think you're in favor of that style of justice, are you?

I have to say, I haven't been following this issue until last night.

They showed the DA at the community college the accuser attends. The guy was there to comfort them, to say that he's going forward with the case. In the many snippets they showed of questioners, most of them seemed to be spilling their bile on him. Him. WTF? He had to leave under police escort.

He went there to help them, and to raise their spirits...and they treated him like he was the rapist. Fuck that.

In light of there being no DNA evidence, has anybody else had the thought that this "dancer" may have been assaulted/plungered with a Lacrosse Stick?

What was the outcome? A conviction for larceny can be brought in to impeach, an arrest can not. I don't know that the DA said there was no DNA evidence. I think he said there was not a match which would mean there is some DNA to match to.

And as far as the stick, happens all the time.

Actually, the DA went to UNC Central, not Duke. So there wouldn't be a riot on the Duke campus unless rioters at UNC Central decided to take it over to Duke.

Two things.

1. The DA went to UNC-Chapel Hill for both undergrad and law school. There is no such school as UNC-Central. The alleged victim was a student at NC Central University.

2. Duke has a good shot at the national championship in women's golf. Don't give up on the riot just yet.

I was referring to the DA going to NC Central University to speak to the students, not where he went to college and law school. Thanks for the correction on the school's name, btw.

There could be a trial, but if so, there will only be one. There will either be a rape trial or a trial for falsely reporting an incident. Not both.

Granted, the DA would get separate juries for both, but the DA's office would get absolutely skewered by the local media if they tried both sides.

As an example of what I'm talking about, consider my recent trial. My client was acquitted because the complainant was lying, and because the evidence proved that she was lying. Did the DA's office turn around and charge the complainant? No way. Admittedly, it was not nearly a high-visibility case as this one is, but the high-visibility aspect is, at least in one sense, even a greater deterrent to what you suggest.

Think the Carolina DA wouldn't love taking down Duke like that. I know, I know.....he's more professional than that. But he's just trying to save face right now. And he's up for election so has to make it look like he's doing something. The one thing I don't buy is the NCCU student saying if the roles had been reversed, there'd be a brother or two lynched by now. WRONG! Let's say a white skank whore/stripper accused some brothers of raping her. She'd have very little support from the white community.

For the record, I grew up in Durham. Didn't go to Duke but know the supposed "friction" between the school and the community has been overblown by the media, if you can imagine such a thing happening. I haven't lived there for a long time but the University is a HUGE employer and a big player in the city. As for the black community, it is one that is well educated, with many working either at Duke or in the Research Triangle Park and I'm sure there is an element that will get riled up by the current embroglio. But when I was there, I never perceived any real animosity between the the university and the city. Remember, hot racial tensions always translate into big ratings.

I pointed out, I think in another thread, the similarities I see between Duke and Notre Dame.

I didn't go to Duke, nor have I lived in Durham, so I can't say for certain what it's like there. I did go to Notre Dame, and saw considerable friction there between students and townies. I surmised, from that experience, that a similar situation might exist at Duke, and helmet agreed with me that it did.

I have no doubt that what you say in your last sentence is true. But you could say the same thing for Notre Dame viz. South Bend, Indiana. Doesn't mean that there still isn't considerable friction between the students and townies at Notre Dame, though.

Police: Duke accuser 'passed-out drunk'

DURHAM, N.C. -- A woman who claims she was sexually assaulted by members of Duke University's lacrosse team was described as "just passed-out drunk" by one of the first police officers to see her, according to a recording of radio traffic released by Durham police on Thursday.

The conversation between the officer and a police dispatcher took place about 1:30 a.m. March 14, about five minutes after a grocery store security guard called 911 to report a woman in the parking lot who would not get out of someone else's car.

The officer gave the dispatcher the police code for an intoxicated person. When asked whether the woman needed medical help, the officer said: "She's breathing and appears to be fine. She's not in distress. She's just passed-out drunk."

The black woman, a 27-year-old dancer and college student, told police she was sexually assaulted and beaten by three white men around midnight at an off-campus party thrown by Duke's lacrosse team. The racially charged allegations have led Duke to cancel the highly ranked team's season and accept the resignation of its coach.

No charges have been filed, but district attorney Mike Nifong has said he believes a crime was committed. Attorneys for the players have said DNA tests failed to connect any players to the alleged attack, and they have urged Nifong to drop his investigation.

Several of the defense attorneys say they expect the district attorney to ask a grand jury on Monday to issue charges in connection with allegations.

"Rest up on Sunday," attorney Kerry Sutton, who represents one of the team's captains, said Thursday.

There has been no official word, however, on whether Nifong intends to present the allegations Monday. His next opportunity would come two weeks later.

I don't think ND is nearly as big as Duke is. Duke's medical center makes up an enormous part of the campus and is a centerpiece of the city. Sure, I'm sure some look at the (under)grad students as in their own little world....and vice versa (actually, many go over to Chapel Hole to party). But I never lived in the little campus bubble at Duke. I lived amongst the locals and just never perceived the overflowing animosity so portrayed by the media. Not saying that element didn't exist but it certainly wasn't overtly evident.

In terms of enrollment, I think ND is probably larger than Duke, although there's no medical school at ND. But the larger enrollment probably translates into more service sector jobs at ND.

Of course, ND is a little isolated from South Bend, not just culturally but geographically as well. Students and townies rarely, if ever, socialize with one another.

So she gets called a few names after she shows up drunk to strip at a party. She then cries rape andthe lacrosse players are the bad guys? I don't think so. First of all, dancing/stripping is a profession in which you expect to be put on display and thus, subjected to the criticisms from your audience. When you show up drunk and all battered and bruised, what do you expect a bunch of drunk college kids to do? She put herself in a bad situation but lets not pretend she was the only or leading victim. This team has now lost their season because this liar couldn't get her act together. Not that it sounds like she has ever had her shit together (taxi cab, exotic dancer, etc...).

The biggest victim here is the lacrosse team for they lost out on their season. Like some of you have said, she should have filed a complaint regarding the way she was treated but because she crossed the line, she loses all credibility in my mind. Likewise, screw Durham for jumping on the bandwagon and protesting the lacrosse team w/o reasonable evidence. Yes they were in the wrong but they didn't do anything near as bad as what this woman did.

And, it looks like the system will work it out.
