I get a kick reading the AlcoSensor IV logs. Some of the test readings are as low as .012, .028, .034.

Readings this low are priceless when cross-examining the cops. Just goes to show just how reliable the FST's are LOL.

Yeah, I was going with the more obvious problem with Diego's argument (and one a little easier for a layman to follow than the mens rea issue).

Murder is a malice crime, but I believe attenpted murder actually requires specific intent, rather than malice.

How is that even possible? Three DUIs in this state gets you 25 to life.

My cousin got a DUI back in '96. Thirteen years later he is driving home from Hooters and gets stopped no more than a quarter-mile from his house. Another DUI.

He goes to court and the judge shows no mercy. His license is suspended six months and he has to serve 80 hours of community service. My cousin's occupation requires him to drive to a number of trainyards and supervise the switching and what not. Well, his license is suspended, so he can't do his job. What does he do? Takes all of his vacation and sick days and he barely makes it to the six month time period.

Court day. He goes and sees the judge and presents to him the 80 hours of community service and no incidents while on probation. Judge just looks up at him and says. I'm gonna give you another 90 days to think about what you did. Cus has to tell his employer at this point. He gets demoted.

Seems a bit harsh, but every person convicted of one DUI should think about that before getting behind the wheel. I have no sympathy for 2nd time offenders.

You never hear about 4-time DUI offenders in Germany. Wanna know why?...

Following a DUI arrest, you lose your license for six months, your car is impounded and sold, you pay a fine of $15,000 Euros and have to undergo a psychological test to determine if you'll get your license back at all. 70% of people fail this test the first time. Prior to taking this psych test, you're given an alcohol test that's so sensitive that you have to go stone-cold sober for at least four months or you'll fail.

The krauts system works because it's focused on deterring future DUIs with harsh punishments. Our system in the USA is focused on generating revenue for states and trial attorneys, rather than actually serving as a genuine deterrent.

That's not to say that the kraut's system is something to exactly emulate. This guy couldn't pass the alcohol screen due to a blood chemistry issue and ended up getting a liver biopsy to prove he wasn't a problem drinker in an attempt to get his license back. :shock:

They treat driving as an absolute privilege though. It's not like the US where you can score one at the DMV for $20 after taking a driver's training course and logging a few hours of classroom time. The Krauts require a minimum of 45 hours of classroom time, 12 hours of "driving theory" and $2000. No, I did not misplace the decimal point.

I was an exchange student in Germany in '87 when I was 16. If they party at someone's house they either show up with a designated driver or it's expected that they're spending the night...even if they don't know the people. It's just a complete different mentality and it all has to do with the fact that the worst possible thing you can do over there is get pulled over for drinking and driving.

Wow! That would eliminate 99% of this board. That alcohol test couldn't be an alcohol test as it leaves your system fairly quickly. They are most likely checking liver enzymes with something like an ALT/AST type test. So that would mean they give you an initial one to compare it at least 3 months later and charge you for all of the above?

Then you could have Wags lecturing them on the benefits of Bud Light. You would pass the liver enzymes test but fail the psych test.

You forgot to add in the untold numbers of convicts that walk out the front doors of the various penal institutions in and around the Salem area, they look around and like what they see ( other cons, drugs, substandard housing etc..), and decide to STAY in the Salem area, and that always adds more to the gentrification of the area.

I do a couple of jobs right in that area a couple of times per year, an there is nothing good about anything associated with Lancaster Drive in Salem...

So you're saying that leaving his young kid fatherless is the way to go? He hasn't caused any personal injury as a result of driving drunk AFAIK. Yes, that may be due to dumb luck, but that's a factor which the Courts can, and do, take into consideration in imposing sentence. As they should.

And before anyone accuses me of suggesting that he should go unpunished, that's not what I'm saying at all. I'm just saying that there's a pretty significant difference, in this case, between the appropriate level of punishment and capital punishment.
