Federal rule change could nix Sheriff Arpaio’s immigrant sweeps; he calls move ‘amnesty’
Phoenix Business Journal - by Mike Sunnucks

New rules announced Friday by the Barack Obama administration could nix crime suppression sweeps and immigration raids conducted by Maricopa County Sheriff Joe Arpaio.

Arpaio said he plans to continue to conduct his immigration enforcement efforts under state laws, despite changes to federal rules related to local police arresting illegal immigrants.

“To me, it looks like some form of amnesty,” Arpaio told the Phoenix Business Journal on Friday.

U.S. Homeland Security Secretary Janet Napolitano announced the changes to federal rules. Napolitano, also the former governor of Arizona, said Friday that DHS and the U.S. Immigration and Customs Enforcement agency would need to re-sign agreements with local police agencies, such as the Maricopa County Sheriff’s Office. Those agreements train local police on immigration laws and allow them to sometimes arrest and detain illegal immigrants.

“Only those agencies with newly signed agreements will be permitted to continue enforcing immigration law,” said a DHS statement on Friday.

That could allow the White House to derail Arpaio’s immigration enforcement actions, which have been made through a federal partnership that trains deputies to enforce immigration laws and pick up illegal immigrants. The sheriff also conducts workplace and drop-house raids under state laws.

The MCSO has had an immigration enforcement agreement with the feds since April 2007

The sheriff was not sure whether the federal government would maintain its agreement with the MCSO. If it does not, he said the feds will have to take over the processing and detention of some of the illegal immigrants picked up in the Phoenix area.

Napolitano also said Friday that federal rules regarding local police picking up illegal immigrants would be changed to focus on arresting those charged with violent and serious crimes.

“To address concerns that individuals may be arrested for minor offenses as a guise to initiate removal proceedings, the new agreement explains that participating local law enforcement agencies are required to pursue all criminal charges that originally caused the offender to be taken into custody,” the DHS statement said.

The sheriff’s crime sweeps and immigration raids are under investigation by the Obama administration for possibly unfairly targeting Hispanics. He also faces lawsuits from the American Civil Liberties Union and Hispanic activists over his immigration enforcement policies.

Napolitano also said Friday the feds had signed new immigration enforcement and cooperation agreements with police departments in Mesa and Florence. Former Mesa Police Chief George Gascon, who opposed Arpaio’s efforts earlier this year to conduct crime sweeps in that city, recently became police chief in San Francisco.

Arpaio lawyers ask for investigation

PHOENIX - Lawyers for Maricopa County Sheriff Joe Arpaio have asked for a probe of federal officials who are investigating the sheriff's office for alleged discrimination and unconstitutional searches.

Arpaio lawyer Robert Driscoll said in a letter that Department of Justice investigators conducting the civil rights probe improperly shared documents with the Department of Homeland Security, which is auditing Arpaio's use of federal immigration powers.

Arpaio said both examinations are focused on immigration enforcement efforts. Critics said that deputies racially profiled people during immigration sweeps.

Department of Justice spokesman Alejandro Miyar said the agency will review the letter but declined to comment on Arpaio's investigation request.

The letter came one day after Arpaio charged that the Departments of Justice and Homeland Security have an ulterior motive in their investigation into the sheriff's office.

"After serving with the DOJ for nearly 30 years as a ranking official with the DEA, it is almost painful to have to ask for this investigation," Arpaio said. "But I must take a stand. Every law enforcement agency the DOJ has investigated in the past has bowed down or rolled over to the federal government. This agency and this sheriff will not. Washington should not tell an elected sheriff how to conduct his law enforcement responsibilities."

Arpaio also said in a press release that the Obama administration is forcing the sheriff to bend on illegal immigration enforcement.

On March 10, the DOJ announced it was launching an investigation into Arpaio and his illegal immigration policies to see if he was racial profiling the Hispanic community.

Arpaio says since the investigation began, the DOJ investigators have lied to senior sheriff's office officials and engaged in an orchestrated scheme designed to acquire documents and witness testimony surreptitiously in order to discredit Arpaio and his office.

In a letter to U.S Attorney General Eric Holder and Homeland Security Secretary Janet Napolitano, Arpaio voiced his concerns about the DOJ's investigation into his office.

One concern was that the DOJ and DHS officials obtained interviews and documents from senior sheriff's officials who should have been entitled to legal counsel but were denied.

Another concern Arpaio has is that in the "100 Day Report" to the Obama Administration, DOJ investigators bragged about the accomplishment of the investigation into Arpaio before they even had any evidence or facts.

Arpaio also says the DOJ admitted it based its investigation into Arpaio solely on "media reports". He says even Congressman John Conyers, Chairman of the Judicial Committee, said he had no facts or evidence other than what he read in the paper before he asked the DOJ to launch its probe.

Arpaio's attorneys say they are certain this investigation is not about justice but rather about a new Washington D.C. administration that wants Arpaio to do things the president's way, for the president's purpose.

Even in liberal San Francisco, she'd be front-page news if she ever came to town.

After the election, with Palin back home but positioning herself for a 2012 presidential run, it was clear she would catch nothing but ridicule from Alaska's Democrats. It was not going to be pretty.

In my decades watching politics in California, I came to have a grudging respect for Willlie Brown. The man absolutely takes over a room when he enters it. The magnitude of his charisma is stunning, and he knows how to use it. He is also crafty and ruthless, and was properly feared when he held political power, by friend and enemy alike. I have seen implaccable foes fold their cards after a private meeting with the man.

If I were a Democrat, I would pay close attention to the lesson he is trying to teach. At this point in his life, Willie Brown can tell the truth as he sees it, and the man knows as much about the fundamentals of politics as anyone alive.
