That's if they're legally recognized. Her atty is saying that they aren't valid due to her signature not being on the licenses. It's easy to understand their willingness to issue the licenses if they knew that they wouldn't be valid.

No, she did not.

She was dragged into court because she chose to not follow a law. The biggest difference here, is you can at least make an argument for the validity of said law. In the case of sanctuary cities, there is no dispute. The local government is blatantly ignoring federal statute.

You could at least show a modicum of consistency here, chip, but consistency is not the strong suit of libtard. Every fukking thing with you guys is situational.

I agree with everything you said. My point was that the feds are selective in their prosecution of law breakers. Despite what Obama and his minions have been spouting, we actually do have a set of laws on the book regarding immigration. They go on about how this system is "broken". The system is "broken" not because it is unworkable. It is broken because it is being ignored. This douche in Kentucky is guilty of doing exactly the same thing. She is chosing to ignore federal regulations. So why is she locked away while the authorities look the other way when it suits their politics?

SCOTUS didn't strike down the whole law regarding marriage. The only struck down the part that references gender.

Page 23 of the majority decision:

"Baker v. Nelson must be and now is overruled, and the State laws challenged by Petitioners in these cases are now held invalid to the extent they exclude same-sex couples from civil marriage on the same terms and conditions as opposite-sex couples."

Uhh Diego do you know Kentucky law and how they wrote these laws?

Some states don't don't just add a law limiting marriages based on sex. They completely rewrote the laws from waiting to licenses to fees etc.

There are a few lawsuits now that are claiming some states shouldn't be issuing any marriage licenses at all because their state laws have been invalidated as per the SCOTUS decision.

I don't know if KY is one who completely rewrote theirs but this would seems to give credence to mvscal's take.

I considered severability but I don't how you can make an argument in favor with a straight face.

As used and recognized in the law of the Commonwealth, "marriage" refers only to the civil status, condition, or relation of one (1) man and one (1) woman united in law for life, for the discharge to each other and the community of the duties legally incumbent upon those whose association is founded on the distinction of sex.

A majority of SCOTUS has ruled that this definition of marriage is unconstitutional. If you sever the definition, what you have left is a series of procedures for the certification and administration of something which has no legal definition under law. What, exactly, is a county clerk supposed to be certifying? It doesn't stand up without it.

I think it's mostly a timing issue due to the legislature being out of session.
