I agree with the Progtards in some respects regarding the manner in which the Second Amendment should be interpreted. The "well-regulated militia" part has to mean something. At the time of its drafting, the United States of America was in its formation stage. There was concern that the British might come back over here and try to retake possession of its former colonies. There was no professional army here to do anything (and the Framers were suspicious of standing armies anyway). And there was concern that the new nation might adopt a British system and tyrannize its citizens.A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
That is why the Third Amendment prohibits the quartering of soldiers. This is why the Tenth Amendment makes it clear that the power conceded to the federal government is limited, and all power which is not expressly granted to it is reserved to the People and the States. I think that in this context, the Second Amendment was to ensure that the People could retain arms in the event they needed to defend themselves from adversaries, foreign or domestic.
I do not believe the Framers envisioned the Second Amendment as protecting the right of the People to attach high capacity magazines to semi-automatic weapons (neither of which existed at the time). But they did want them to be suitably armed. And where that line should be drawn is a tough one. Congress banned the possession of automatic firearms and that was determined to be Constitutional. I think Congress (and the States) have the power to regulate the possession of firearms provided the regulations do not interfere with the ability of a group of individuals to train as a militia with the object being the ability to assist in the defense of the nation against foreign forces and/or tyranny.
The harder question is whether an individual citizen has a right to possess a firearm to protect themself and their loved ones from criminals. I think the individual citizen should have that right. And that probably means that the possession of hand guns and other personal defense weapons must be permitted. But I don't think that logic should apply to AR-15's. They are not really personal defense weapons (maybe household defense weapons). They would be excellent as militia weapons, though. I could see a regulation that permits the ownership of AR-15-type firearms provided they are kept in the home and leave the home only if they are being transported to a range for training/practice.
I would also throw anyone's ass in prison for 30 years if they commit a crime with a firearm, including juveniles. A 12-year old takes a gun into his/her hands to commit a crime, that kids (unfortunately) has to go to the pokey until he/she is 42. No exceptions.
